SELECTMEN'S MEETING MINUTES

Woolwich Town Office - April 12, 1999

ATTENDANCE: Dale Chadbourne, Crispin Connery, David King and Rita Sturtevant

LIQUOR LICENSE PUBLIC HEARING: No one spoke in favor or against the application of SWEETTOME d/b/a The Taste of Maine Restaurant application for a Class I liquor license.

LIQUOR LICENSE APPROVAL: Motion by David, seconded by Rita, to approve the application of SWEETTOME d/b/a The Taste of Maine Restaurant for a Class I liquor license. Passed unanimously.

PREVIOUS MEETING MINUTES: Motion by David, seconded by Rita, to accept the minutes of the March 29, 1999 meeting as printed. Passed unanimously.

ROAD COMMISSIONER'S REPORT: Jack Shaw reported that light grading has been accomplished on most of the town's dirt roads. Lloyd advised that he had received a phone call concerning a dip in the Old Arrowsic Road behind the Woolwich Post Office. Jack advised that he would check to see if a culvert in the area was causing the problem. Jason Shaw and David King agreed to serve on an advisory committee concerning a possible Wiscasset Route 1 Bypass. Lloyd will ask Maybn Martin to serve as an alternate on the advisory committee.

FIRE CHIEF'S REPORT: Dan Skillin reported that there have been seven calls since the last Selectmen's meeting &endash; one structural, one woods, one standby, one 1055, two mutual aids and one false alarm at Brothers Motor Company. Dan asked whether the recycling containers could be move five feet towards the building so that there would be a space for drying hoses. Lloyd will check with Pine Tree Waste. Dan requested the establishment of a petty cash account for the Fire Department to replace the use of the "kitty". The Selectmen believe that such an account might be illegal and/or cause additional work for the Treasurer. They will consult with the Treasurer before making a decision on this matter. Dan advised that his work schedule will prevent him from arriving at future Selectmen's meetings until approximately 6:30 p.m. The Selectmen advised Dan that the Fire Department's 2000-2001 budget should provide for the cost of postage associated with their operations.

OLD BUSINESS:

a. Solid Waste Disposal: Lloyd advised that the first week of trash pickup by Pine Tree Waste was uneventful. David agreed. Lloyd will contact David Kinney, Wiscasset Town Engineer, to determine when the first quarter Transfer Station costs will be available.

NEW BUSINESS:

a.Sagadahoc Bridge Approach: Lloyd advised that he had been contacted by a local businessman who suggested that a public meeting be held with CPM Construction concerning their plans/schedule for construction of the approach to the new Sagadahoc Bridge. The Selectmen concurred and requested Lloyd to arrange such a meeting and to provide appropriate notification to interested parties. Phil Pinkham will also be notified and requested to attend.

b.Alewives Memorandum of Agreement: Motion by David, seconded by Dale, to approve the attached Alewives Memorandum of Agreement. Passed unanimously.

MEMORANDUM OF AGREEMENT BETWEEN INHABITANTS OF THE TOWN OF WOOLWICH AND HERBERT B. LILLY, JR.

 A deviation from the customary procedure of years past is being made once again in an attempt to preserve and enhance the alewife fishery at Nequasset Stream in the Town of Woolwich.

 In consideration of S 1.25 per bushel of alewives harvested, to be paid on or before June 18, 1999, the inhabitants of the Town of Woolwich do license and authorize said Herbert B. Lilly, Jr. of the Town of Woolwich to fish, take and sell for his own purpose and profit alewives from Nequasset Stream during the period from April 15, 1999, to and including June 5, 1999. The taking of alewives shall be prohibited during the 72 hour period from sunrise Monday to sunrise Thursday each week, with the exception that during this closure period up to 4 bushels per day may be taken to support the smoke house operation.

The fishway shall remain open at all times for the upstream and downstream passage of alewives and other migratory fish. Migratory fish such as salmon, shad, or other species except alewives and blueback herring, which enter the trap shall removed and allowed to pass upstream.

The fish ladder into the lake will be made ready and activated by April 15, 1999, to allow the alewives a clear passage into the lake. The fish ladder will be policed for clear passage from April 15, 1999 by the Fish Commissioners and Herbert B. Lilly, Jr. The fish ladder out of the lake will be made ready and activated when necessary in August until October 10, 1999 to allow the juvenile alewives clear passage from the lake to tide water. A schedule will be made up to assure that the Fish Commissioners and Herbert B. Lilly Jr. police this condition on a daily basis.

-The town reserves the rights and privileges of its inhabitants to have fish taken from Nequasset Stream by Herbert B. Lilly, Jr. for food purposes, as shall be determined and authorized by the Fish Commissioners.

Herbert B. Lilly, Jr. shall take the alewives from Nequasset Stream, in accordance with the Statutes of the State of Maine presently in effect which pertain to the unobstructed passage of fish from Nequasset Stream to Nequasset Lake. Further, it shall be the responsibility of Herbert B. Lilly, Jr. and the Fish Commission to be certain that young fish reach tide water.

All dipping pools, walks. platforms, etc. are to be maintained by, and all nets furnished by, Herbert B. Lilly, Jr. for his own use and at his own expense. At the end of the season all dipping pools, walks, platforms, etc. are to be left intact regardless of condition, so they will be there for the next fishing season. Herbert B. Lilly, Jr. shall be responsible for the care and maintenance of the hoist used for dipping fish, and shall return the hoist to the Fish Commissioners in good working condition at the end of the season. At that time all responsibility for the care and maintenance of the hoist shall revert to the Town of Woolwich. The Town shall pay for all repairs to the hoist in excess of fifteen dollars ($15.00). Herbert B. Llllv, Jr. shall be allowed to store all fishing gear in side the fish house during the period of April 1, 1999 to April 1, 2000.

In addition to full payment for fish harvested, Herbert B. Lilly. Jr. shall furnish to the Fish Commissioners a record of the total landings in bushels and the value of the catch on or before June 17, 1999 in compliance with the request of the Maine Department of Marine Resources.

It shall be the responsibly of Herbert B. Lilly, Jr. to see that the electricity, is turned on at the beginning of the fishing season and off at the end thereof, and to pay for all electrical costs charged by central Maine Power Company.

I. The ground of the west side of the Dam is to be kept free of debris from April 1 to June 15, 1999.

c. Postage Expenses: In order to provide for more complete accountability of operating costs, the Selectmen will request the Fire Department and the School Committee to budget for postage costs associated with their accounts payable expenses. This change in budgeting will go into effect in the 2000-2001 fiscal year.

d. "On the Road Show: The Selectmen decided that the budget road show will be advertised on Channel 12 and through a news release but will not be advertised commercially.

e. General Assistance Workshop: Lloyd will conduct a general assistance workshop on Monday, April 26, 1999, at 5:00 p.m.

CODES ENFORCEMENT OFFICER'S REPORT: Bill Longley reported that a private septic system was leaching into the Nequasset watershed and the owner may lack the financial resources to correct the problem. As a result, Bill requested signatory authority to apply for a state grant if the owner meets the income guidelines. Bill also advised that such an action would not result in the town becoming financially obligated. Motion by David, seconded by Rita, to grant Bill the requested signatory authority. Passed unanimously.
